How To File For Divorce In Rhode Island Going through a divorce can be a painful, but necessary, process. What is the proper procedure on how to file for divorce in Rhode Island?

There are a few different ways to handle your divorce, and the best way to handle your divorce will depend on whether your divorce is contested or uncontested.

  1. An uncontested divorce is one where both sides agree, not only to dissolve the marriage, but to respect the terms put forth by both sides. While, in theory, this means that the divorce process should be relatively easy – and it is, comparatively speaking – Rhode Island law does not have a provision for a simplified dissolution. Therefore, the easiest way to file for an uncontested divorce is to file for what’s called a no fault divorce, which is not the same as a simplified dissolution.
  2. A contested divorce, on the other hand, is one where the two parties cannot come to an agreement about the terms and conditions of the divorce, and therefore, the divorce requires much more time – both in litigation, and in negotiation – to settle.

In order to qualify to file for a divorce in Rhode Island, the following conditions must apply:

  1. You, and/or your spouse, must live in Rhode Island for at least one year (and you don’t necessarily need to live with him/her), and,
  2. You, and/or your spouse, must feel as though your differences are irreconcilable, or,
  3. You have lived apart from your spouse for at least three years.
